The Probate Process

Probate is a complex legal process, and most of us aren’t entirely familiar with the ins and outs of it until we find ourselves having to apply for it. But with the right support, the probate process doesn’t have to be overwhelming.

Probate relates to the legal right you have to distribute a loved one’s wealth and assets following their death. Even if you are the named Executor of the will, you cannot access the estate until you have been legally granted probate. This is because the will needs checking to ensure it is correct and valid as part of the probate process.

If your loved one has passed away without a will and therefore no executor, you need to apply to become the administrator of the estate. Once that has been granted, you can then apply for probate. The administrator of the estate is usually the spouse or eldest child, although this is circumstantial.

Depending on the size and complexity of the estate, including the property, finances and assets, probate can take between 1-2 years.
